Federal trademark registration itself takes time — typically 12 to 18 months depending on the USPTO's workload and whether any issues arise. The speed refers to getting you into the process immediately, not to the government's timeline.What is an office action, and am I covered if I receive one?
An office action is a formal letter from a USPTO examining attorney raising a legal objection to your application — it could be a question about your goods and services description, a likelihood-of-confusion refusal, or another issue. Office actions are common and not a sign that your application is doomed. My flat fee includes my response to any office actions issued during your application, so you will never receive a surprise invoice for that work.What if my trademark search reveals a conflict?
If the search turns up a conflict that makes registration unlikely or risky, I will tell you before anything is filed. You will receive my honest legal opinion, and we will discuss your options — which may include modifying the mark, identifying a different class, or reconsidering the filing altogether. The $2,500 package includes the USPTO filing fee for one international class. If your brand needs protection across multiple classes — for example, both clothing and online education — additional classes can be added for the corresponding USPTO filing fee plus a service fee. I'll let you know during intake if multiple classes are recommended for your situation.Do I need to already be using my brand name to file?
Not necessarily. You can file on an "intent-to-use" basis if you have a bona fide intention to use the mark in commerce. I'll determine the correct filing basis for your situation during intake and explain what each basis means for your timeline and rights.
