Two Documents That Work Together to Cover You Completely
Most people think of a Power of Attorney as one document. In practice, there are two distinct designations — and both matter.
Financial Power of Attorney
A Financial Power of Attorney authorizes someone you choose — called your agent — to manage your finances if you become incapacitated or are otherwise unable to act. That includes paying bills, managing bank accounts, handling real estate transactions, and keeping your business running. Without this document, even a spouse may not have legal authority to act on your behalf.
Healthcare Power of Attorney
A Healthcare Power of Attorney designates a trusted person to make medical decisions for you if you are unable to make them yourself. This is separate from a living will. Where a living will records your wishes, a Healthcare Power of Attorney names a person with the legal authority to carry them out — and to make judgment calls in situations your document may not anticipate.
Together, these two documents form the legal backbone of any complete estate plan. I draft both so they work in alignment with your will, trust, and the rest of your planning documents.
